Digital Single Market: European Parliament adopts new regulation on the free flow of non-personal data in the EU

On October 4, 2018, the European Parliament adopted the proposed EU Regulation on the Free Flow of Non-Personal Data in the European Union.

The Regulation aims at removing obstacles to the free movement of non-personal data within the European Union. The Regulation does not cover data mobility outside the EU. The approved Regulation does not have an impact on the application of the General Data Protection Regulation (GDPR), as it does not cover personal data. The two Regulations will function together to enable the free flow of any data – personal and non-personal – and create a single market space for data. According to the press release, “in case of a mixed dataset, the GDPR provision guaranteeing free flow of personal data will apply to the personal data part of the set, and the free flow of non-personal data principle will apply to the non-personal part.”

The FAQ ensure that “the Commission will publish informative guidance on the interaction between the Regulation on the free flow of non-personal data and the General Data Protection Regulation, regarding the interaction of the both regulations in the context of mixed data sets”.

After the adoption of the text by the European Parliament, the Council of the EU will adopt the Regulation in the coming weeks, before it will enter into force by the end of the year. Once formally adopted, Member States will have 6 months to apply the new Regulation.
